The Administrative Court of Appeal has overturned the Administrative Court’s judgment and upheld the Swedish Tax Agency’s decision of 19 October 2022. Consequently, Ellos AB must pay approximately SEK 20.5 million in tax and approximately SEK 14.5 million in tax surcharges. Ellos Group intends to appeal the judgment.
The tax dispute, which Ellos Holding AB (publ) (“Ellos Group”) previously has disclosed, concerns a deduction of SEK 158.6 million claimed by the subsidiary Ellos AB in its income tax return for the 2020 tax year. The deduction related to costs under a framework agreement concerning a purchasing platform within the group of Ellos Group’s former owner, FNG NV. The Swedish Tax Agency denied the deduction and, on 19 October 2022, decided to impose tax of SEK 20.5 million and tax surcharges of SEK 14.5 million on Ellos AB. In April 2024, the Administrative Court in Jönköping set aside the Swedish Tax Agency’s decision, following which the Swedish Tax Agency appealed the judgment to the Administrative Court of Appeal in Jönköping.
